A situation ive never been in until now

hi,

I own the official site for some band which has content such as lyrics, profiles and mp3s.

Some other site has blatantly taken my mp3s which i have legal rights to. I dont want them having any of my mp3s as they are exclusive for my site only.

This other site (called 2step) has violated my disclaimer, being;

Quote: ..none of these mp3s can be used for public uses..

Does anyone have any idea what i should do?

I was thinking about contacting them and asking them to take it off but what if they refused?

2step have also violated another site's disclaimer, they also hacked that other site so im worried to might happen to my site.

Send them an email, but make it sound like it's from a lawyer and that if they don't remove the files within 48 hours, you'll be forced to take legal action. If they don't remove the files, contact their host and report the copyright issue, usually hosts shut down sites that are in violation to these terms. I beleive there are places where you can get premade legal letters, maybe you can do a search or someone else knows where you can get them.

They will probably quote you this (from their disclaimer):

Sounds like a pretty thin veil to me... I wonder if it will stand up?

Another way to look at it, if they don't take it off and havent changed the names then it's more advertising for your bands site as people could search for their music and info. Try getting them off teh other site first, you could always report them to there web host as well.
just keep an eye on your stats and see if you do get anymore hits than before

On those lines, you could even negotiate a link to your site, since it's official...

You only posted a small quote from your diclaimer but I'm thinking that you might want to have that looked at by a lawyer. It should fully flesh out what is and is not permitted (and again, I haven't seen the whole thing so what you've got may go into more detail). Just in case this happens again you may want to have a more legally defined disclaimer to fall back on.
